IDA's Decision on OpenNet's 13 November 2009 Reconsideration Request
On 21 December 2009, IDA issued its decision on OpenNet's reconsideration request dated 13 November 2009. OpenNet had requested IDA to reconsider certain aspects of IDA's Direction dated 30 October 2009. After careful consideration of the issues raised by OpenNet in the reconsideration request, IDA has decided to maintain IDA's 30 October 2009 Direction.
Request by OpenNet for Reconsideration of IDA's Direction dated 30 October 2009 In Relation to Incorporation of Specific Drafting Language to OpenNet's Proposed ICO
On 13 November 2009, OpenNet submitted a request for IDA to reconsider certain aspects of IDA's Direction dated 30 October 2009 which had directed OpenNet to incorporate specific drafting language in its proposed modifications to its interconnection offer ("ICO").
OpenNet's Submission of Clean Copy of Approved ICO
OpenNet submitted a clean copy of its approved ICO incorporating IDA's 30 October 2009 Directed Amendments.
IDA's Direction to OpenNet to Incorporate Specific Drafting Language
On 30 October 2009, IDA directed OpenNet to incorporate specific drafting language ("Directed Amendments") in its proposed modifications to its Interconnection Offer ("ICO"). OpenNet's proposed modifications incorporating the Directed Amendments are hereby approved and will take effect from a date to be notified by IDA in due course.
As part of the process to improve clarity of the ICO, OpenNet has revised its earlier set of diagrams to better illustrate the key features in OpenNet's network that would be provided under the respective ICO services.
OpenNet's Revised Model Confidentiality Agreement ("MCA")
Following IDA's 3 July 2009 direct modifications to OpenNet's proposed Interconnection Offer ("ICO"), OpenNet has revised its MCA to govern preservation of proprietary or commercially sensitive information disclosed during negotiations of OpenNet's provision of Mandated Services in addition to negotiations of Customised Agreements. OpenNet has also updated its MCA taking into consideration IDA's approved changes to Nucleus Connect Pte Ltd's MCA. IDA approved the OpenNet’s revised MCA on 26 October 2009.

On 11 September 2009, IDA has issued its decision on OpenNet’s reconsideration request dated 21 August 2009. OpenNet has requested IDA to reconsider certain aspects of IDA's Direction dated 7 August 2009. After careful consideration and taking into account the requirements of the NetCo Interconnection Code 2009 and the Telecom Competition Code 2005, IDA has decided to maintain IDA’s 7 August 2009 Direction.
OpenNet's Submission of Proposed ICO Modifications Arising from IDA's Decision on OpenNet's 17 July 2009 Reconsideration Request
Pursuant to IDA's 20 August 2009 Decision on OpenNet's 17 July 2009 Reconsideration Request, OpenNet has submitted its proposed modifications to its proposed ICO for IDA's review on 3 September 2009.

Pursuant to IDA's 7 August 2009 Direction, OpenNet has submitted its proposed modifications to the Additional ICO Schedule 12A, Schedule 15 and Schedule 18 for IDA's review on 21 August 2009.
IDA's Decision on OpenNet's Reconsideration Request
IDA has issued its decision on OpenNet's reconsideration request of 17 July 2009. OpenNet's has requested IDA to reconsider certain aspects of IDA's Direction dated 3 July 2009. After careful consideration and taking into account the requirements of the NetCo Interconnection Code 2009 and the Telecom Competition Code 2005, IDA has rejected OpenNet's reconsideration request, except to vary the issue of scheduled service interruptions. IDA has directed OpenNet to submit to IDA for review and approval, OpenNet's proposed modifications to its proposed ICO as varied by IDA's decision, by 3 Sep 2009.
IDA's decision on the issue of scheduled service interruptions is as follows:
OpenNet has submitted that in some cases, it may be necessary for OpenNet to coordinate their maintenance activities with property owners and/or relevant government agencies, to minimise disturbances to the public and it therefore may not always be possible to schedule the maintenance work within the specified 1am-6am period.
IDA recognises that there might be instances where it might be unavoidable for OpenNet to carry out planned maintenance work outside of the specified 1am - 6am period, for example, to prevent delays to public works such as Main Upgrading Projects and Lift Upgrading Projects. Hence, IDA is prepared to consider allowing OpenNet to carry out planned maintenance between 1am to 6am except where it is unavoidable for OpenNet to do so.
Submission of OpenNet's Proposed ICO Modifications
Pursuant to IDA's 3 July 2009 Direction and extension of submission granted on 30 July 2009, OpenNet has submitted its proposed ICO modifications for IDA's review on 11 August 2009.
Directed Modifications to OpenNet's Proposed Additional ICO Schedules
Following the industry consultation on OpenNet Pte.Ltd.'s ("OpenNet") proposed additional Interconnection Offer ("ICO") Schedule 12A, and the consequential amendments to Schedule 15 and Schedule 18, IDA has directed OpenNet to modify particular provisions of the proposed additional ICO schedules. OpenNet will have to submit to IDA the revised proposed additional ICO schedules that incorporate the IDA directed modifications by 21 August 2009.
IDA has been requested by OpenNet to extend the deadline for the submission of the revised draft Interconnection offer ("ICO") incorporating the modifications required by IDA. The deadline for the submission will be extended to Tuesday, 11 August 2009.

OpenNet will have to submit to IDA a revised proposed ICO that incorporates the IDA directed modifications by 3 August 2009.
Public Consultation on Proposed Interconnection Offer for the Provision of Services on the Next Generation National Broadband Network: Additional Schedules
On 25 February 2009, IDA sought views from the industry on the proposed Interconnection Offer ("ICO") for the provision of services over the passive infrastructure of Singapore's Next Generation National Broadband Network ("NGNBN") submitted by OpenNet Pte Limited ("OpenNet") to IDA for approval pursuant to the requirements under the NGNBN NetCo Request for Proposal (the "RFP"). The consultation on the proposed ICO closed on 9 April 2009 and IDA is currently reviewing the comments received from the industry.
OpenNet has subsequently submitted a proposed ICO schedule (i.e., Schedule 12A), to IDA for approval, to enable a NetCo Qualifying Person to connect its co-located equipment to that of another Qualifying Person who have successfully obtained co-location service within the same OpenNet's Central Office ("QP to QP Interconnection Service"). Before IDA grants its approval, IDA would like to seek views on the proposed ICO Schedule 12A, as well as the consequential changes proposed by OpenNet to Schedule 15 (Charges) and Schedule 18 (Dictionary).

OpenNet's Submission of Revised Model Confidentiality Agreement to Incorporate Specific Drafting Language
OpenNet Pte Ltd ("OpenNet") submitted a clean copy of its revised Model Confidentiality Agreement ("MCA") incorporating the Specific Drafting Language.
IDA's Notification to OpenNet to Incorporate Specific Drafting Language to Proposed Model Confidentiality Agreement
On 27 March 2009, IDA issued a letter to OpenNet Pte Ltd ("OpenNet") to incorporate in its proposed modifications to its Model Confidentiality Agreement ("MCA"), specific drafting language ("Required Amendments"). Submission of OpenNet's Proposed Modifications to the Model Confidentiality Agreement
Pursuant to IDA's notification of 17 March 2009, OpenNet Pte.Ltd. ("OpenNet") has submitted its proposed modifications to its Model Confidentiality Agreement ("MCA") for IDA's review and approval.
IDA has received a request from the industry to extend the deadline for the submission of comments to the Proposed Interconnection Offer for the Provision of Services on the Next Generation National Broadband Network. The deadline shall be extended and all responses must now be submitted to IDA by noon, 9 April 2009.
Modifications to the Proposed Model Confidentiality Agreement
Following the industry consultation on OpenNet Pte.Ltd.'s ("OpenNet") proposed Model Confidentiality Agreement ("MCA"), the IDA has required OpenNet to modify particular provisions of its proposed MCA. OpenNet will have to submit to IDA a revised proposed MCA that incorporates the modifications required by IDA within 7 days from the date of the notification.
The Info-communications Development Authority of Singapore ("IDA") requested for proposals for a Network Company ("NetCo") to develop the passive infrastructure of Singapore's Next Generation National Broadband Network ("NGNBN") on 11 December 2007. The NGNBN shall act as a strategic enabler for Singapore to exploit new economic opportunities in this digital age, through much faster broadband access and higher broadband take-up by households and businesses, leading to greater productivity gains. From this competitive tender process, the OpenNet Consortium was subsequently selected based on its NetCo bid proposal.
Pursuant to the requirements under the NGNBN NetCo Request for Proposal (the "RFP"), OpenNet Private Limited ("OpenNet") has submitted to IDA for approval, its proposed Interconnection Offer ("ICO") for the provision of services on the NGNBN as well as the proposed Model Confidentiality Agreement ("MCA"). Before IDA grants approval for the proposed ICO and MCA, IDA would like to seek views on the said documents.
All views and comments should be submitted in writing and in both hard and soft copies (preferably in Microsoft Word format). The following timeframes shall be adhered to:
- All comments on the proposed ICO to reach IDA by 12 noon, 9 April 2009; and
- All comments on the proposed MCA to reach IDA by 12 noon, 9 March 2009.
